Page No.# 2/3 This is an application under Section 483 of BNSS, 2023 in connection with Basistha P.S. Case No. 178/2026, under Sections 308(5)(4)/3(5) of BNS, for granting bail to the petitioner. The allegation against the petitioner is that he alongwith his associates used to extract money from the commercial vehicles which used to pass through Khanapara bound for Morigaon, Nagaon, etc., on the pretext of collecting parking fees. The learned counsel for the petitioner submits that the petitioner has taken a parking area on lease from a private person which falls under Meghalaya and accordingly, he charges legitimate fees for parking. On the other hand, the learned Additional P.P. submits that as per material available in the Case Diary, the petitioner alongwith his associates have been collecting money from passenger buses which are not parked in any private parking places and by passing through highway. It further appears that the petitioner alongwith his associates are acting in a criminal kind involving extorting money from transporters. Considering the incriminating materials available in the Case Diary and the fact that the alleged acts of the petitioner and his associates in collecting illegal fees from passenger vehicles plying on public highway has larger impact on
Page No.# 3/3 society and also amounts to offences of economic nature, the prayer for bail stands rejected at this stage. The petition is dismissed accordingly. Send back the Case Diary.
