Sinha, A.P.P. 03/ 13.01.2026: Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Dandai P.S. Case No. 40/2021, registered under sections 364(A), 302, 201 and 34 of I.P.C, pending in the Court of learned Chief Judicial Magistrate, Garhwa. 3. Learned counsel for the petitioners submits that allegation is made in the F.I.R that all the accused persons who are family members had murdered the son of the informant. He next submits that chargesheet has been submitted against one Yugal Ram @ Jugal Ram and investigation against these petitioners is kept pending. He further submits that Yugal Ram @ Jugal Ram has already been granted regular bail in B.A. No. 1356 of 2022 by the Co-ordinate Bench of this Court. He also submits that since investigation is kept pending against the petitioners, the petitioners have apprehension of arrest. He submits that petitioners have got no criminal antecedent which is disclosed in para 10 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail. 4. Learned counsel for the State opposes the prayer and submits ( 2026:JHHC:809 ) that allegation of murder is there. 5. Looking into contents of F.I.R. it transpires that allegation is made against all the accused persons and it has been pointed out that all the accused persons are family members. Further chargesheet has been submitted against one Yugal Ram @ Jugal Ram and investigation against these petitioners is kept pending. The said Yugal Ram @ Jugal Ram has already been granted regular bail in B.A. No. 1356 of 2022 by the Co- ordinate Bench of this Court. It has come that death has occurred due to drowning in well and there is no ante-mortem injury. The petitioners have got no criminal antecedent which is disclosed in para 10 of the petition. 6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Garhwa, in connection with Dandai P.S.
