Mr. Siddhant Manral, learned counsel for the respondent no.5 through VC. 4. The instant petition is moved by the petitioner, herein, which is a company, preferred through its authorized representative, engaged in providing professional sanitization, waste management and door- to-door garbage collection service across various part of the India, including State of Uttarakhand. 5. Brief facts of the case are that the Nagar Palika Parishad, Gadarpur, invited tender through Government E-Marketplace (GeM) for providing complete sanitation services in seven wards of Gadarpur and the contract period is 39 months and the monthly expenditure is about Rs.22.50 lacs. It is contended that 76 sanitation workers, who are the local residents of Gadarpur and the surrounding areas have been engaged by the petitioner’s company, however, since last few days some group of employees who are led by the respondent nos.6 to 8, herein, are obstructing day-to-day work and motivating other employees also for their vested interest, and some of the workers are refrained from performing their duties and going on illegal strike, and now they are creating atmosphere of fear and there is an apprehension of danger to the life to the representative of the petitioner’s company. The private respondents Rajat S/o Shri Nanhe, Ankit S/o Shri Ashok and Ankit S/o Ramesh, are the key persons, who are creating hindrance and are motivating the other workers and there is a threat to life and liberty to the officials of the petitioner’s company. In this regard, a representation is also made to the SHO and SSP, which is annexed as Annexure Nos.6 and 7 to the petition. 6. Taking into consideration the issue in hand, the District Magistrate and the EO of the concerned Nagar Palika were called and are directed to join the proceedings through VC after post lunch session and in compliance thereof ADM and EO joined through VC. The petitioner’s company already represented to the SHO and the SSP. 7. Let the SSP may assess the threat perception, if any, to the petitioner’s company as well as their officials from the respondent nos.6 to 8, and if he comes to the conclusion that there is any threat, take appropriate steps forthwith. 8. In addition to this, the ADM who join the proceedings through VC is directed to immediately call a meeting with the SSP and call upon two representative of the company as well as respondent nos.6 to 8 and the Executive Officer of the Nagar Palika Parishad, and examine the grievances of the workers and make all efforts to resolve their dispute. The ADM and the SSP, shall ensure that no such untoward incident be created and they shall advice to the workers not to obstruct and perform their duties, and if they have any grievance raise their grievances in writing, so that the appropriate steps be taken to redress their grievances. 9.
