The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No.246 of 2024, corresponding to G.R. No.2180 of 2024, registered for the offence under Sections 334(2) and 303(2) of the BNS, pending in the Court of the learned Judicial Magistrate, 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that one Brindawan Topdar was found in theft of the articles from the godown of the informant and it has also come in the CCTV footage. He further submits that the petitioner was not found in the CCTV footage. He then submits that in identical situation, one co-accused has been granted privilege of anticipatory bail by a Coordinate Bench of this Court in A.B.A. No.812 of 2025, vide order dated 06.02.2025. He next submits that the petitioner has got no criminal antecedent, as disclosed in paragraph 16 of this application. 4. Learned counsel appearing for the State opposed the prayer and submits that the present petitioner is happened to be the associate of the said Brindawan Topdar. Considering that the petitioner has not been found in the CCTV footage and Brindawan Topdar was found in the CCTV footage and the petitioner has got no criminal antecedent as disclosed in paragraph 16 and in identical situation, one co-accused has been granted bail in A.B.A. No.812 of 2025 and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad in connection with Govindpur P.S. Case No.246 of 2024, corresponding to G.R. No.2180 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
