Learned counsel for the petitioners submits that though the property in question has been declared as Auqaf property by the Board of Auqaf, West Bengal, the private respondents along with their associates are organising mela in a portion of the property without requisite permission from the Board. The Chief Executive Officer, Board of Auqaf, by a letter issued on 18th January, 2026 requested the Superintendent of Police, Hooghly (Rural) to look into the issue of illegal organising of mela and protect the Auqaf property. Learned counsel for the private respondents submits that permission to organise the mela was granted by the Hooghly Zila Parishad from 15th January, 2026 to 20th January, 2026. Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that the property in question has been declared to be Auqaf 2 property by the Board of Auqaf, West Bengal. The Chief Executive Officer of the Board of Auqaf, West Bengal is not before this Court. On prayer of the petitioners liberty is granted to approach the appropriate forum for redressal of their grievance. The writ petition is accordingly disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
