This is an application under Section 482 of the BNS, 2023 in respect of PRC No.165/2026 pending in the court of learned Chief Judicial Magistrate, South Salmara, Mankachar. 3. The petitioner Baharul Islam Prodhani @ Baharul @ Babu Pagla has been shown as an absconder in the charge sheet. He now apprehends that if he appears before the court below, he shall be remanded to custody. The petitioner expresses his intention to contest the case. 4. I have considered the submissions made by the learned counsels for both sides. 5. Since, the petitioner is interested in facing the trial, he should be given adequate opportunity to that effect. Therefore, his application is allowed. 6. The petitioner Baharul Islam Prodhani @ Baharul @ Babu Pagla is directed to appear before the court of learned Chief Judicial Magistrate, South Salmara, Mankachar in connection with PRC No.165/2026 within next 15 days from today. On his appearance, he shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the said court i.e. learned Chief Judicial Magistrate, South Salmara, Mankachar.
