1. The petitioner has filed this writ petition seeking following reliefs:-

“10.1 That, this Hon'ble Court may kindly be pleased

set-aside

no. B-1/2-1/Pado./16/2025-26/693 Nava Raipur dated 25.04.2025 (Annexure P/1), whereby, the junior to the petitioner have been considered for promotion to the accountant. 10.2 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to consider the petitioner for the post of Accountant with all consequential benefits from 25.12.2024 in the interest of justice. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief’s which may deem fit and proper in the facts and circumstances of the case may also be allowed.”
2. Learned counsel for the petitioner submits that the petitioner was appointed on the post of Assistant Grade – III on 08.11.2012 at Krishi Upaj Mandi Samiti, Jairamnagar, District – Bilaspur. Respondents have published a gradation list and have called for the objections, from aggrieved employees. In the list, name of petitioner was placed at appropriate place, therefore, at that time, petitioner did not submit any objection. When promotion order was issued, petitioner found that the Respondent No. 5 who is junior to the petitioner was promoted, aggrieved with which, petitioner submitted representation before the Respondent No. 2, but, till date no decision has been taken and therefore, direction be issued to the Respondent No. 2 to consider and take decision on the representation dated 17.07.2025 (Annexure P/8) submitted by the petitioner at the earliest within specified time frame. 3. On the other hand, learned counsel for the Respondents/State would submit that as petitioner is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 2 to consider and take decision on the representation dated 17.07.2025 (Annexure P/8), he is having no objection to the limited prayer. 4. I have heard learned counsel for the parties and perused the documents placed on record. 3

The grievance of petitioner is that the Respondent No. 4 who is junior to the petitioner in the gradation list was promoted superseding the petitioner against which, petitioner had submitted representation before the Respondent No. 2 on 17.07.2025 (Annexure P/8) and as submitted by the counsel for petitioner, till date no decision has been taken on the said representation.
In the aforementioned facts of the case, without observing into merits of the case, this writ petition at this stage is disposed of permitting the petitioner to submit a fresh comprehensive representation raising all the grounds as raised in this writ petition along with all supporting documents before the Respondent No. 2 and if such a representation is submitted by the petitioner, Respondent No. 2 shall consider and take decision on the representation to be submitted by the petitioner on its own merits in accordance with law, expeditiously, preferably within a period of 02 months from the date of receipt of representation. 6. With the aforesaid observation and direction, this writ petition stands
