1. This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:-
“i To kindly issue an appropriate writ of certiorari and quash the impugned order dated 24/10/2025 (ANNEXURE P/1) as being arbitrary, illegal, and without authority of law. VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.02.20 11:05:47 +0530

To kindly issue an appropriate writ of mandamus directing the respondents to fix and pay the salary of the petitioner in accordance with the Finance Department instructions issued from time to time, including instruction Nos. 30/2015, 35/2017, 16/2019, and 22/2023, and to continue to pay the current salary accordingly. iii.To kindly direct the respondents to release the arrears of salary payable to the petitioner, amounting to approximately Rs. 5,77,687/- (up to October, 2025, as per chart enclosed with ANNEXURE P/15), along with all consequential benefits. iv. To kindly issue an appropriate direction restraining the respondents from effecting any recovery of salary already paid to the petitioner, the same having been disbursed pursuant to the decisions of the competent authority and in accordance with the Finance Department instructions and the decision taken in the Second General Body Meeting of CASU dated 04/02/2015 (Item No. 11). V. Any other relief, including cost of the petition, which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, may also kindly be granted in favour of the petitioner.”

During the course of hearing, learned counsel for the petitioner submits that the petitioner was appointed on the post of Date Entry Operator (Contractual) under the Chhattisgarh Social Audit Unit (herein after referred to as CASU) vide appointment order dated 21.09.2015 (Annexure-P/3) on salary of Rs.10,670/-. The appointment of the petitioner was made in accordance with the provisions of the Chhattisgarh Civil Services (Contractual Appointment) Rules, 2012. The salary of the petitioner is being paid based on the circular issued by the Finance Department from time to

He also contended that initially vide circular issued by the Finance Department on 27.07.2013 (Annexure-P/5) and by further circulars issued from time to time thereafter the pay has been enhanced and the last circular was issued on 02.08.2023. He contended that according to the last circular issued by the Finance Department, the petitioner is paid salary under pay-matrix level VI, of Rs.23,350/- per month. Subsequently, the Director, Chhattisgarh Social Audit Unit (CASU), Raipur, vide letter dated 24.10.2025 (Annexure-P/5) informed the petitioner that the pay of the petitioner be reduced from Rs.23,350/- to Rs.10,670/- He also contended that the pay has to be given to the contractual employees according to the circulars issued by the Finance Department. He also submits that the salary has been reduced since December, 2024 and thereby, petitioner is facing huge financial loss and also facing difficulties for survival of himself and his family. Instead of taking decision by the CASU on the representation of petitioner, it is forwarded to the State Government i.e. Respondents No.1, but, till date no decision has been taken. 3. Learned counsel for the State submits that the documents placed upon the petition clearly mentioned that the Director, Chhattisgarh Social Audit Unit (CASU), Raipur has forwarded the claim of the petitioner to the State Government and it is pending and, therefore, it will be considered accordance with law. 4. I have learned counsel for the parties and perused the material available on record. 5.
The grievance of the petitioner is that suddenly pay of the petitioner is reduced from Rs.23,350/- to Rs.10,670/- since December, 2024 and since last more than one year petitioner is being paid reduced salary. From the document (Annexure-P/1), it is apparent that earlier
4 petitioner has filed a writ petition before this Court and, the same was disposed of directing the competent authority to consider and decided the representation submitted by the petitioner. But, the competitive authority i.e, the respondent No.3 instead of taking decision has forwarded the claim of the petitioner to the State Government. 6. In the aforesaid facts of the case when the respondent No.3 find himself to be not a competent authority and decision is to be taken by the respondent No.1 and further the claim of the petitioner is still pending before the respondent No.1, the writ petition is disposed of, permitting the petitioner to submit a fresh representation before the respondents No.1 and 3 raising all the grounds along with all supporting documents. If such a representation is submitted the concerned respondents-authorities shall consider and take decision on the representation to be submitted by the petitioner, in accordance with law, taking into account the relevant circulars issued by the respondent No.02 herein from time to time with regard to fixation of the salary of the employees to be appointed on contract basis under the provisions of the Chhattisgarh Civil Services (Contractual Appointment), Rules 2012. Expeditiously preferably within a period of three months from the date of receipt of representation. 7. With the aforesaid observation and direction, the instant writ petition stands disposed of.
