1. The present bail application has been filed under Section 483 BNSS, 2023 against the order dated 12.02.2026, passed by the learned Session Judge, Jhalawar, in Bail Application No. 100/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No. 71/2026, registered at Police Station Kotwali, District Jhalawar, for the offences under Section 308(2), 351(2), 221, 61(2), 111(2)(B), 111(4) BNS,2023.

Learned counsel for the petitioner submits that, except for the offence of organized crime, all other offences are triable by a Magistrate. He further submits that as many as ten (10) co-accused have already been enlarged on bail either by a Co-ordinate Bench of this Court or by the learned trial Court.

Learned counsel for the petitioner further submits that the conclusion of the trial is likely to take a considerable amount of

He further contends that the case of the present petitioner does not stand on a lesser footing from that of the co-accused who have already been enlarged on bail. He, therefore, prays that the petitioner may also be enlarged on bail, particularly in view of the fact that he has been in judicial custody since 30.01.2026.
4. Learned Public Prosecutor vehemently opposes the bail application.
5. Heard learned counsel for the petitioner and learned Public Prosecutor and perused the material available on record.

Without expressing any opinion on the merits of the case and upon a consideration of the arguments advanced and the fact that the offences are triable by Magistrate and the charge-sheet having been filed and other co-accused having been enlarged on bail, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.
7. Consequently, the bail application is allowed. It is ordered that the petitioner namely-Radheyshyam S/o Chaturbhuj arrested in connection with F.I.R. No. 71/2026 registered at Police Station Kotwali, District Jhalawar shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/ (Rupees One Lakh Only) with two sureties of Rs.50,000/ (Rupees Fifty Thousand Only) each, subject to the satisfaction of the learned Trial Court, with the stipulation that he shall appear before the said Court on all dates of hearing and as and when called upon to do so until completion of the trial, subject to the following conditions:
[2026:RJ-JP:23188] (3 of 3) [CRLMB-3265/2026] (i) The petitioner shall not leave the country without the prior permission of the Court; (ii) The petitioner shall not commit any offence similar to the offence of which he is accused or suspected to have committed; and (iii) The petitioner shall not, directly or indirectly, make any inducement, threat, or promise to any person acquainted with the facts of the case so as to dissuade such person from disclosing those facts to the Court or to any police officer, nor shall he tamper with the evidence.
