JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 24.06.2026 This is a common order for these two bail applications as both the bail applications have arisen out of the same FIR. 2. Heard the learned H R Ahmed appearing for the petitioners. Also heard Mr. Bhaskar Sarma, the learned Additional Public Prosecutor for the State of Page No.# 3/3 Assam. 3. This is an application under Section 483 and 482 of the BNSS, 2023 praying for grant of pre-arrest bail as well as regular bail in respect of Gauripur P.S. Case No. 93/2026. 4. The wife of the petitioner Sanowar Mandal committed suicide by hanging. The brother of the deceased woman had lodged the FIR alleging that Sanowar Mandal and his brothers and other family members have killed the deceased and hanged her dead body. 5. The case diary reveals that Sanowar Mondal was having illicit relationship with another woman and on that ground quarrel took place between them and ultimately she committed suicide. 6. The petitioner Sanowar Mondal has already spent 90 days in custody. Therefore, he is entitled to default bail. Therefore, it is hereby directed that the petitioner, who was arrested in connection with Gauripur P.S. Case No. 93/2026, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dhubri. 7. In respect of the other petitioners Bellal Mandal, Fazar Ali @ Fajar Ali Mandal, Abdul Salam @ Salam and Behula Bibi, the case diary does not reveal sufficient materials. Therefore, their prayer for bail is also allowed. 8. It is further directed that the petitioner Bellal Mandal, who was arrested in connection with Gauripur P.S. Case No. 93/2026, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Dhubri. 9. It is also directed that in the event of arrest in connection with Gauripur P.S. Case No. 93/2026, the petitioners Fazar Ali @ Fajar Ali Mandal, Abdul Salam @ Salam and Behula Bibi shall be released on bail of ₹25,000/- each with sureties of like amount to the satisfaction of the arresting authority. With the aforesaid direction, both the Bail Application and the Anticipatory Bail Application are disposed of accordingly. The CD (s) shall be returned. JUDGE Comparing Assistant
