Notice. Mr. L.N. Sharma, learned Additional Advocate General, appears and waives service of notice on behalf of the respondents/State. 2. The petitioner has approached this Court for the following main reliefs: (i)
“Issue an appropriate writ/order/direction directing the respondents to grant the petitioner an extension of joining time for at least 10 days for joining her place of posting at Dr. Rajender Prasad Government Medical 1 Whether reporters of Local Papers may be allowed to see the judgment? 2 College (Dr. RPGMC), Tanda, District Kangra, Himachal Pradesh, in view of the medical condition of her husband and herself; and (ii) Quash and set aside the impugned order dated 12.02.2026 (Annexure P-4) whereby the petitioner’s representation seeking extension of joining time has been rejected.:
3. It is contended by learned counsel for the petitioner that, vide notification dated 03.02.2026, the petitioner has been promoted and placed at Serial No. 11 as Tutor-cum-Clinical Instructor. As per the said notification, the officers mentioned therein were required to submit their acceptance by joining at the new place of posting within 10 days from the date of issuance of the notification. It was further stipulated that the incumbents shall submit their joining reports to the Department through proper channel, failing which it would be presumed that the officer is not interested in the placement. 4. The petitioner has placed on record a medical prescription dated 09.02.2026 (Annexure P-2), issued under the signatures of Orthopedic Surgeon, DDZH, Shimla, whereby the doctor advised the petitioner to take rest for two weeks. The petitioner thereafter submitted a representation dated 09.02.2026 (Annexure P-3) to the
3 Principal Secretary (Health) to the Government of Himachal Pradesh, seeking extension of time to join as Tutor-cum-CI on medical grounds. However, the said request was rejected on 12.02.2026, vide Annexure P4. 5. I have heard Mr. Balwant Thakur, learned counsel for the petitioner, and Mr. L.N. Sharma, learned Additional Advocate General, for the respondent/State, and have carefully perused the record. 6.
The representation dated 09.02.2026 (Annexure P-3), seeking extension of time to join on medical grounds and supported by the medical prescription, clearly indicate that the doctor had advised the petitioner to take rest for two weeks. Therefore, on account of medical exigency, she could not comply with the notification dated 03.02.2026. 7. This Court is of the considered view that, on medical grounds, the time for joining deserves to be extended till 21.02.2026. 8. It is made clear that in case the petitioner does not join after 21.02.2026, the order passed by the Secretary (Health) to the Government of Himachal Pradesh shall stand revived, and the petitioner shall face consequences in
4 accordance with law. Accordingly, the time to join is extended till 21.02.2026. 9. Petition stands disposed of, so also the pending application(s), if any. 13 th February, 2026
