Mr. Hemant Kumar Thakur, Advocate vice Mr. Narender Singh, Advocate, for the respondent. By way of instant application filed under Section 5 of Limitation Act, prayer has been made on behalf of the applicant/ petitioner for condonation of delay in maintaining the accompanying criminal revision petition, which is barred by limitation. Mr. Hemant Kumar Thakur, Advocate vice Mr. Narender Singh, Advocate, while putting in appearance on behalf of the respondent, states that he does not intend to file reply and shall have no objection in case delay in maintaining the accompanying criminal revision petition is condoned. Having carefully perused the averments contained in the application, which is duly supported by an affidavit, this Court finds no impediment in accepting the prayer, especially when delay caused in maintaining accompanying criminal revision petition does not appear to be intentional or willful, rather same has occurred on account of circumstances, which were completely beyond the control of the applicant, as such, the same deserves to be condoned.
In view of above, delay, which has been otherwise sufficiently explained is condoned. The application is disposed of. Cr.

In the meantime, substantive sentence imposed by the learned court below shall remain suspended, subject to applicant’s depositing 50% of the compensation amount, which shall also include amount, if any, already deposited and furnishing personal bonds in the sum of Rs. 20,000/- (rupees twenty thousand only) with one surety in the like amount to the satisfaction of the learned trial Court within a period of four weeks, with condition that the applicant shall appear in the court as and when directed and shall surrender to serve out the sentence imposed, in case the revision is ultimately dismissed.
