ORAL ORDER These Criminal Petitions are filed by the de-facto complainant under Section 239 (2) of the Code of Criminal Procedure (now Section 483(3) of BNSS) seeking cancellation of anticipatory bail granted to respondent No.2.

2. Criminal Petition No.12306/2025 arises out of the
order dated 03.06.2025 passed in Criminal Miscellaneous No.513/2025 (Crime No.41/2025 of the Hassan Women Police Station) on the file of the V Additional District and Sessions Judge, Hassan (for short 'the trial Court').
3. Criminal Petition No.12323/2025 arises out of the
order dated 25.06.2025 passed in Criminal Miscellaneous No.499/2025 (Crime No.44/2025 of the Puttur Women Police Station) on the file of the VI Additional District and Sessions Judge, Dakshina Kannada, Mangaluru (for short 'the trial Court').

Learned counsel for the petitioners contends that the trial Court has granted anticipatory bail to respondent No.2 without affording an opportunity of hearing to the de-facto complainant. The orders are contrary to the law laid down by the Apex Court in JAGJEET SINGH AND OTHERS Vs ASHISH MISHRA @

MONU AND ANOTHER1 (Jagjeet Singh), which mandates hearing of the victim. It is submitted that the offences alleged are serious in nature and the investigation is still in progress at the time of grant of bail. The Trial Court has failed to apply judicial mind while granting anticipatory bail.
5. Learned counsel for respondent No.2 submits that the charge sheet has already been filed in Spl.C.No.5040/2025. Respondent No.2 has filed Criminal Petition No.272/2026 seeking to quash the proceedings under Section 482 of the Cr.P.C. This Court has granted an interim stay of further proceedings in Spl.C.No.5040/2025. In view of the stay of the proceedings, the question of cancellation of anticipatory bail does not arise at this stage.
6. Undisputedly, respondent No.2 had already approached this Court in Criminal Petition No.272/2026 seeking quashing of proceedings and this Court has

granted an interim order staying further proceeding in Spl.C.No.5040/2025. In light of the said stay order, continuation of criminal proceedings is presently kept in abeyance. When the proceedings are stayed, question of cancellation of anticipatory bail, which is incidental to such proceedings, does not arise for consideration at this stage.
7. Therefore, without going to the merits of the
contentions urged regarding non-hearing of the victim or nature of the offence, this Court is of the view that the present Criminal Petition do not survive for consideration at this stage. However, liberty deserves to be reserved to the petitioner to revive their remedy depending upon the outcome of the quashing of proceedings. Accordingly, this Court pass the following:
ORDER i. The Criminal Petitions are disposed of. ii. Liberty is reserved to the petitioners to seek recall of the order in the event the

Criminal Petitions No.272/2026 is dismissed or any adverse order is passed against respondent No.2.
