Pursuant to the earlier direction Mr. Nandy submits an order dated 05.02.2026 wherein the Court decided to alter the charges which came to his notice while drafting the judgment. Consequently about 15 witnesses were recalled. All the 15 witnesses have been examined and only one witness namely, Dilip Sen, may be the investigating officer is left for examination on recall. The learned Court while recalling such witness categorically recorded that the Court was aware regarding the factum that the accused person is detained for more than 9 years. However, for ends of justice such witness was recalled and every efforts were exerted for completing those witnesses within a period of one month from the date on which the said recall order was passed. Considering the efforts put in by the learned trial Judge, I am of the opinion that it would not be fit and proper to release the
2 petitioner at the penaltimate stage when the Court is about to take a decision on the merits of the case. The learned trial Court has been putting in efforts. Considering the period of detention of the accused person/persons, I am of the opinion that the trial Court will pronounce his verdict on or before 30th of June, 2026. With the aforesaid observations CRM (M) 689 of 2026 is dismissed. Learned advocate for the State would communicate this order to the learned trial Court for taking necessary steps. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
