The present petition has been preferred by petitioner under Article 226 RUKHSAR BANO Digitally signed by RUKHSAR BANO Date: 2026.02.26 16:40:52 +0530 2 of the Constitution of India seeking following relief(s) : “10.1 The Hon’ble Court may kindly be pleased to issue direction to the respondent authorities to take appropriate action on the complaint of the petitioner. 10.2 The Hon’ble Court may kindly be pleased to issue direction to the respondents to not to construct any drain over the land of the petitioner and other residents of Aakash Marg Colony. 10.3 Any other consequential relief which this Hon’ble Court deems fit and proper and for which the petitioner is entitled, may also kindly be granted to the petitioner, in the interest of justice.” 3. Learned counsel for the the petitioner submits that the petitioner is a resident of Aakash Marg Colony, situated at Mungeli Road, Uslapur, District Bilaspur. He further submits that respondent No.5 is constructing a drainage over the petitioner’s private land. The petitioner has submitted an application dated 06.02.2026 (Annexure -P/4) before the respondent No.4 seeking demarcation of his land. Hence, he prays that at this stage, this petition may be disposed of with a direction to respondent No.5 not to proceed with the construction of the said drainage over the petitioner’s private land until demarcation of the said land is carried out. 4. Learned counsel appearing for the respondent No.5 submits that if, in the demarcation report, it is found that the proposed land for construction of the drainage falls within the private land of the petitioner, then appropriate steps shall be taken in accordance with law. 5. Having considered the limited prayer of the petitioner and his apprehension, this writ petition is, at this stage, disposed of directing respondent No.5 to stop the construction of drainage till demarcation pertaining to the petitioner’s private land is carried out. 3 6. The State counsel is directed to instruct respondent No.4 to expedite the demarcation proceedings, and the same shall be carried out within one week from today. It is further directed that respondent No.4 shall supply a copy of the demarcation report to respondent No.5. 7. With aforesaid observation and direction, this writ petition stands disposed of. 8.
