Delay Condonation Application No. 01 of 2026 1. Heard Sri Shivajee Srivastava, learned counsel for the revisionist and learned A.G.A. for the State. 2. Learned counsel for the revisionist submits that the present criminal revision has been filed along with the delay condonation application as there is delay of 85 days in filing this criminal revision. 3. Cause shown for the delay is sufficient. 4. Accordingly, the delay is condoned. This application is allowed. Order on Criminal Revision 1. Learned counsel for the revisionist submits that the present criminal revision has been filed against the order of interim maintenance with the relief which has been mentioned in the prayer clause. The prayer clause is being delineated below :- "It is, therefore, most respectfully prayed that this Hon'ble Court may kindly be pleased to allow the present criminal revision and set-aside the impugned order dated 18.08.2025 passed by Principal Judge, Family Court, Ghazipur in Criminal Misc. Case No.221 of 2024 (Samauti Vs. Shambhunath) Under Section 125 Cr.P.C. Police Station-Shadiyabad, Versus Counsel for Revisionist(s) : Sanjoo Yadav, Shivajee Srivastava, Shrikant Singh Yadav Counsel for Opposite Party(s) : G.A. Shambhu @ Shambhunath Singh .....Revisionist(s) State of U.P. and Another .....Opposite Party(s) District-Ghazipur. It is further prayed that this Hon'ble Court may kindly be pleased to stay the effect and operation of the impugned the order dated 18.08.2025 passed by Principal Judge, Family Court, Ghazipur in Criminal Misc. Case No.221 of 2024 (Samauti Vs. Shambhunath) Under Section 125 Cr.P.C. Police Station-Shadiyabad, District-Ghazipur, during the pendency of this criminal revision before this Hon'ble Court, and/or pass such other or further order which this Hon'ble Court may deem fit and proper under the circumstances of the case." 2. Learned counsel for the revisionist further submits that he does not want to press this revision and prays that the Principal Judge, Family Court, Ghazipur be directed to decide the pending application under Section 125 Cr.P.C., preferably within a period of six months. 3. The alternative prayer of the revisionist is allowed. The learned Principal Judge, Family Court, Ghazipur, is directed to conclude the proceedings of 125 Cr.P.C. finally as early as possible, preferably within six months from today. 4. With the above direction, this criminal revision is disposed of. 5. It is made clear that this Court has not granted any relief to the revisionist at this stage.
