The grievance of the petitioner is directed against the failure of WBSEDCL to shift an electric pole. It is submitted on behalf of the petitioner that an electric pole is situated on land which belongs to the petitioner. This fact is disputed by the WBSEDCL who submit that the land does not belong to the petitioner. On behalf of the WBSEDCL, a Report is filed dated 10.03.2026 whereby the WBSEDCL has highlighted that the subject pole was erected as far back as in 2016. In order to shift the pole, the petitioner has been requested to identify a new location and provide necessary way leave clearance. Notwithstanding receipt of such communication the petitioner has not taken any steps in the matter. In view of the nature of the disputes raised, WPA 28704 of 2024 stands disposed of by directing the concerned District Magistrate having jurisdiction to adjudicate upon the grievance of the petitioner.
2 It is made clear that there has been no expression in the merits of the case and all questions are left open to be decided by the concerned District Magistrate in accordance with law after granting an opportunity of hearing to both the parties including the WBSDECL. The entire exercise is to be completed within a period of eight weeks from the date of communication of this order.
