Mr. Vijay Khanduri, learned Brief Holder for the State. 3. present applicant Sachin alias Anas, S/o Shankar is praying for bail in reference to FIR dated 03.03.2023 bearing FIR No. 0122 of 2023 registered as P.S. Gangnahar District Haridwar wherein the applicant is implicated for the offences punishable under Sections 307 and 506 of IPC and now after investigation the charge sheet has been filed and the trial has already been commenced. 4. It is argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated and the charge sheet has already been filed and as per the doctor’s statement all UKHC010108912026 2026:UHC:6319 the injuries are simple in nature. He further submits that the present applicant is languishing in jail since April 2023 and have no criminal antecedents. He further submits that out of total 12 prosecution witnesses up till date only 8 prosecution witnesses have been examined and there is no possibility that the trial would be expedited as soon. 5. On the other side, Mr. Vijay Khanduri, learned Brief Holder for the State have not disputed this fact that the trial has already been commenced and the present applicant is languishing in jail since April 2023 and the trial has not been expedited so far and he has no criminal antecedents. 6. After hearing the submissions of the learned counsel for the parties and taking into consideration that the applicant is languishing in jail since April 2023 and as per the doctor’s opinion all injuries are simple in nature and the applicant have no criminal antecedent,this Court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, bail application is allowed. 8. Let the applicant Sachin alias Anas, be released on bail on his executing a UKHC010108912026 2026:UHC:6319 personal bond and furnishing two reliable sureties each of the like amount to the satisfaction of the court concerned subject to the following conditions:- (i) After being released on bail, the applicant shall attend the trial court proceeding on each and every date without seeking unnecessary adjournment. (ii) The applicant shall not make any attempt to influence the witnesses and will not give threatening to the victim as well as his family members. (iii) The applicant will immediately surrender his passport, if any, with the Trial Court. (Rakesh Thapliyal, J.) 24-07-2026 Nahid
