The present bail second application under Section 483 of BNSS is filed by the applicant-accused Sampat S/o Shri Sharwan Lal seeking bail in respect of a criminal case registered as FIR No. 88/2026 dated 22.03.2026 registered at Police Station Masuda, District Beawar, for the offence under Sections 8 and 15 of NDPS Act, 1985. 2. Learned counsel for the applicant submits that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submits that there are no chance of fleeing of applicant-accused from the jurisdiction of this Hon’ble Court. He also submits that the [2026:RJ-JP:24032] (2 of 4) [CRLMB-8160/2026] applicant undertakes not to repeat offence and cooperate with trial, which will take time. 3. Learned counsel for the applicant submits that first bail application was dismissed as withdrawn on 01.05.2026 with liberty to file after charge-sheet. He also submitted that now the charge-sheet has already been filed. He also submitted that co-accused Ratan Lal was already granted bail by this Hon'ble Court on 01.05.2026. He further submitted that two more criminal cases relating to NDPS Act were registered against the applicant-accused wherein the applicant is facing trial. He also referred the material on record and submitted that the police has not complied mandatory provision under the NDPS Act before effecting search and seizure. He also referred the recovered quantity and submitted that the poppy straw is less than commercial. 4. Aforesaid contentions were opposed by learned Public Prosecutor and he submitted that the offence is serious in nature and role and involvement of applicant is established from the material on record. 5. Heard learned counsel for the applicant-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. On 22.03.2026 SHO Police Station Masuda, District Beawar has searched house of accused- Sampat and recovered 3.031 Kg of poppy straw stored in a plastic gunny bag and pouches. On basis of recovery memo FIR No. 88/2026 was registered under Section 8/15 of NDPS Act. The applicant- accused was arrested and a charge-sheet has already been [2026:RJ-JP:24032] (3 of 4) [CRLMB-8160/2026] filed. On basis of information accused- Ratan Lal was charged under Section 8/29 of NDPS Act. Ratan Lal was granted bail by this Court on 011.05.2026. The first bail application present applicant-accused was dismissed as withdrawn on 01.05.2026, the recovered quantity is less than commercial. There are two more criminal cases relating to NDPS Act against the applicant-accused. 7. This Court also finds that the applicant-accused has remained in custody for a considerable period of time and that the trial/proceedings are likely to take further time to conclude. Therefore, looking to the entirety of the facts and circumstances of the case and without expressing any opinion on the merits thereof, this Court deems it appropriate to grant bail to the applicant-accused. 8. Thus, the instant bail application filed on behalf of applicant- accused Sampat S/o Shri Sharwan Lal, is hereby allowed and the applicant-accused is ordered to be released on bail upon furnishing a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:- (i) The applicant-accused shall not tamper with evidence or influence the witness in any manner. (ii) The applicant-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law. [2026:RJ-JP:24032] (4 of 4) [CRLMB-8160/2026] (iii) The applicant-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court. (iv) In case of any violation of above conditions, the bail granted to the applicant-accused shall be liable to be canceled. 9.
