Learned advocate appearing for the petitioner submits that the petitioner is in custody since 02.06.2025. There are hardly any materials to suggest that the petitioner was involved in the alleged offence. Petitioner has been implicated on the basis of a narrative created by the prosecution for having extra marital affair with the deceased. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that there are CCTV footages and CDRs implicating the present petitioner and there are witnesses who suggest that in close proximity of time, the deceased divulged that she would meet the present petitioner. Be that as it may, prosecution has relied upon 32 witnesses; till date, only charge has been framed.
2 Accordingly, I direct the learned Trial Court that within a period of six months from the next date so fixed, at least ten witnesses be examined who are vulnerable. Learned Trial Court would adhere to the directions passed above for completing ten witnesses within the said period. Petitioner would renew his prayer for bail after the aforesaid period is over. At this stage, the prayer for bail of the petitioner is rejected. Learned advocates for the petitioner and the State will communicate this order to the learned Trial Court for taking necessary action. The application for bail, being CRM (M) 2115 of 2025, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
