This is defendants’ petition challenging the judgment and order dated 29.05.2019, passed by First Additional District Judge, Rishikesh in Civil Revision No. 46/2019. By the said judgment, civil revision filed by plaintiff (respondent herein), challenging an order passed by Trial Court, whereby application under Order 26 Rule 9 CPC was allowed, was dismissed. 5. Mr. Piyush Garg, learned counsel appearing for plaintiff-respondent submits that the Original Suit filed by his client, which is numbered as O.S. No. 69/2013 was dismissed and the counter- claim filed by petitioner was allowed, vide judgment and order dated 12.01.2023. He submits that his client has filed an UKHC010135132019 2026:UHC:6415 appeal under Section 96 CPC, which is pending before coordinate Bench of this Court. 6. As per information received from Civil Judge (Senior Division), Rishikesh, vide letter dated 12.06.2026, it is revealed that O.S. No. 69 of 2013 was disposed of on 12.01.2023. 7. After decision in the suit, challenge to the judgment rendered by Additional District Judge in a revision do not survive. 8. The writ petition is, accordingly, dismissed as infructuous.
