(3 of 3) [CRLMB-7840/2026]
9. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.
10. Considering the overall facts and circumstances of the case, particularly the fact that the FIR was lodged in the year 2006, the Investigating Agency submitted a negative Final Report, and cognizance was taken in the year 2016, coupled with the fact that the offences alleged are triable by a Magistrate and do not involve any heinous offence, this Court is of the view that the petitioners could have been summoned through a bailable warrant. However, since the petitioners have been directly summoned through an arrest warrant, this Court deems it appropriate to direct the petitioner to appear before the Trial Court on or before
30.06.2026.
11. In the event the petitioners appear before the learned Trial Court on or before 30.06.2026, the learned Trial Court shall accept his personal bond and sureties, as may be considered necessary, to secure his presence on each and every date of hearing and on furnishing of the said personal bonds and sureties, the petitioners shall not be arrested. The bail application stands disposed of.
12. Pending application(s), if any, also stand disposed of.
