None appears for the Panchayat despite service. Heard learned counsels for the parties. The only grievance of the petitioner in the writ petition is that the private respondents have raised construction without obtaining any sanctioned plan. Identical issue was raised by the petitioner before this Court earlier and by an order passed on 17th December, 2025 in WPA 18901 of 2024, a co ordinate Bench of this Court has observed that there is a sanctioned plan in place. The writ petition was dismissed on such count. The present writ petition discloses the same cause of action as in the earlier one and is not maintainable. Accordingly, the writ petition is dismissed. 2 However, in the event the petitioner seeks to challenge the title and possession of the private respondents in respect of the plot in question, he is at liberty to approach the appropriate civil forum for redressal of his grievance. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
