JUSTICE E.S.INDIRESH ORAL ORDER In this Writ Petition, the petitioners are assailing the Order dated 14.10.2024 (Annexure-A) passed by the respondent No.4 against the petitioners in the impugned orders at Annexures - A, A1 to A8 series and consequently, sought for directions to the respondent Nos.3 and 4 to allow the petitioners to discharge their duties as Board of Directors of the respondent No.5 - Society. 2. Having taken note of the submissions made by the learned counsels appearing for the parties, the - 5 - HC-KAR NC: 2026:KHC:14579 WP No. 30596 of 2024 petitioners herein have been disqualified under Section 27(2)(a) of the Karnataka Co-operative Societies Act, 1959, on 14.10.2024 and the said period has come to a conclusion upon lapse of one (1) year. It is also to be noted from the writ petition that the respondent No.1 - State has appointed the Administrator for managing the day to day affairs of the respondent No.5 - Society. 3. In that view of the matter, since the period has lapsed as in respect of the disqualification order made against the petitioners, I am of the opinion that, no further orders are required to be made insofar as adjudicating on the impugned order at Annexures - A, A1 to A8 series is concerned. However, in view of the efflux of time, the period suffered by the petitioners shall not come in the way of the petitioners as well as no further action has to be taken against the petitioners insofar as the lapsing period is concerned. Since the disqualified period is concluded and for all other purposes, it is open for the petitioners to participate in the affairs of the Society being - 6 - HC-KAR NC: 2026:KHC:14579 WP No. 30596 of 2024 a member, insofar as the respondent No.5 - Society is concerned.
