02/ 05.02.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Giridih (M) P.S. Case No. 376/2024, registered under sections 191(2)/191(3)/190/109/118 of BNS added section 103(1) of BNS, pending in the Court of learned S.D.J.M, Giridih.

Learned counsel for the petitioner submits that the name of the petitioner has come in the confessional statement and the petitioner was not present at the spot. He next submits that allegations of assault are there against Md. Taufique who has assaulted the deceased. He also submits that the petitioner is vegetable seller having no criminal antecedent disclosed in para 17 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that the name of the petitioner has come in the confessional statement.

In the F.I.R there is direct allegation against Md. Taufique of assault upon the deceased. The name of the petitioner has come in the confessional statement. Further it has been pointed out that petitioner is vegetable seller having no criminal antecedent disclosed in para 17 of the petition. On query made by the Court, learned counsel for the State submits

that case diary is silent on the point of criminal antecedent of the petitioner.
6. In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named, petitioner is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M, Giridih, in connection with Giridih (M) P.S. Case No. 376/2024, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
