CORAM: JUSTICE SIBO SANKAR MISHRA
Order No.
ORDER 22.04.2026
01.
1. Heard.
2. The petitioner is seeking pre-arrest bail in connection with C.T. Case No.50 of 2023 arising out of Phiringia P.S. Case no.44 of 2023 for the offence under Sections 20(b)(ii)(C)/25/29 of the NDPS Act pending in the Court of the learned Special Judge, Phulbani.
3.
Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R.
4. The prosecution case, in brief, is that on 20.09.2025 at about 11:42 P.M., the Sub-Inspector of Bangiriposi Police Station lodged a written report (F.I.R.) before the IIC of Phiringia Police Station alleging, inter alia, that he had received reliable information that two persons were in possession of a
huge quantity of ganja and were transporting the same in an auto bearing Registration No. OD-12A-1350. Acting on such information, the police party proceeded to the spot and noticed a black-coloured vehicle approaching from the side of village Lendrigaon. The vehicle was intercepted, whereupon one person was apprehended while the other managed to escape from the spot. Upon being questioned, the apprehended person disclosed his identity. On search, a total of 37 kg 200 grams of contraband ganja was recovered from the vehicle. On demand, he failed to produce any valid documents in support of the transportation of the said contraband. Consequently, the accused person was arrested, and the contraband articles were seized, along with other incriminating materials.
5. Regard being had to the gravity of offence and the nature of allegation made against the petitioner, I am not inclined to entertain this petition.
6. Accordingly, the ABLAPL is dismissed.
