Present applicant-Suraj Sheel, S/o Bablu Sheel is praying for bail in pending Sessions Trial No.06 of 2023 State vs. Ravi Khairati & others wherein he is facing trial for the offences punishable under Section 399 & 402 of IPC read with Section 25 (1-B)(a) and 25(1-B)(b) of Arms Act arising out of Case Crime No.497 of 2022. 5. It is argued by learned counsel for the applicant that infact, the applicant was already enlarged on bail by the trial court on 29.09.2023 but thereafter on certain dates he could not appear before the trial court and subsequently non-bailable-warrant was issued on 16.03.2024 and thereafter he was arrested on 05.05.2025 and since then he is in custody. 6. On the other side, Mr. Pratiroop Pandey, learned AGA has not disputed that the applicant was already on bail but due to non appearance non-bailable-warrant was issued and subsequently he was arrested. 7. After hearing the submission of learned counsel for the parties and taking into consideration that applicant was already on bail, this Court is of the view that applicant deserves for bail. 8. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 9. Let the present applicant- Suraj Sheel be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned. 10.
