The present bail application has been filed under Section 483 BNSS, 2023 against the order dated 02.06.2026 passed by learned Session Judge, Dausa, District Dausa, in Criminal Misc. Bail Application No.136/2026, whereby the bail application of the petitioner was rejected in connection with F.I.R. No.EPF/DSA(10064)2026-2027/015, Police Station-Excise Dausa, District Dausa, for the offences under Section 19/54 of the Rajasthan Excise Act, 1950. 2. Learned counsel for the petitioner submits that petitioner has been in custody since 25.05.2026 and the alleged offences are triable by Magistrate; investigation/trial will take considerable time. He has no criminal antecedents. Therefore, he prays that the petitioner may be enlarged on bail. (2 of 2) [CRLMB-8997/2026] 4. Learned Public Prosecutor opposes the present bail application. 5. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 6. Without expressing any opinion on the merits of the case, considering the fact that the offences are triable by Magistrate; there are no criminal antecedents against the accused petitioner; investigation/trial will take considerable time and further considering the fact that the maximum punishment for the alleged offence is three years, this Court is of the opinion that the present bail application filed by the petitioner deserves to be accepted. 7. Consequently, the bail application is allowed. It is ordered that the accused-petitioner Dhara Singh Son Of Ramkaran arrested in connection with F.I.R. No.EPF/DSA(10064)2026- 2027/015, Police Station Excise Dausa, District Dausa, shall be released on bail; provided he furnishes a personal bond of Rs.1,00,000/ (Rs. One Lakh Only) with two sureties of Rs. 50,000/- (Rs. Fifty Thousand Only) each, to the satisfaction of the learned Trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so till the completion of the trial.
