The present second bail application under Section 483 of BNSS is filed by the applicant-accused Rajkumar S/o Shri Jile Singh Sharma seeking bail in respect of a criminal case registered as FIR No.389/2024 dated 17.11.2024 registered at Police Station Special Crime and Cyber Crime, Commissionerate Jaipur, for the offence under Sections 318(4), 319(2), 316(2) and 61(2)(B) of BNS, 2023 and Sections 66-C and 66-D of IT Act 2. Learned counsel for the applicant submitted that the applicant has been falsely implicated in the matter and the investigation against him is complete and he is no more required in investigation. He further submitted that there are [2026:RJ-JP:24018] (2 of 4) [CRLMB-5879/2026] no chance of fleeing of applicant accused from the jurisdiction of this Hon’ble Court. He also submitted that the applicant undertakes not to repeat offence and cooperate with investigation/trial, which will take time. 3. Learned counsel for the applicant-accused has submitted that the applicant is in custody since 19.12.2024 and the offence is triable by Magistrate. He also submitted that except the current case, there is no other criminal case against the applicant. He also submitted that the allegation against the applicant-accused is to assist other accused and facilitate them in commission of crime. He also submitted that even till date, the recording of PW-1 has not been completed by the trial Court. He also referred to the material and submitted that other accused are involved in several offences, but the present applicant-accused is only involved in current case. 4. Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature. Learned Public Prosecutor has also submitted a report received from Police Station Special Crime and Cyber Crime, Commissionerate Jaipur and submitted that total 15 complaints were received against the bank account of the applicant. 5. Heard learned counsel for the petitioner-accused and learned Public Prosecutor. Perused the material placed on record by both the parties. 6. First bail application of the applicant was dismissed on 11.06.2025 along with bail application of Uppalapuvu Vinay [2026:RJ-JP:24018] (3 of 4) [CRLMB-5879/2026] Kumar. The offence is triable by Magistrate and currently the criminal case is pending before learned Additional Chief Judicial Magistrate No.8, Jaipur Metropolitan First. The report indicate that on 18.09.2025, statement of Amit Nehra were recorded, but the same remained inconclusive and till date, no evidence has been recorded. The police report indicate that present applicant-accused was one of the facilitator and ₹10,00,000/- was deposited in UCO Bank account of the present applicant-accused. Present applicant was arrested on 20.12.2024 as offence under Sections 318(4), 319(2), 316(2) and 61(2) of BNS, 2023 and Sections 66-C and 66-D of IT Act was found proved against him. The police has also mentioned that 15 complaints were also registered about the UCO Bank account operated by the present applicant. 7. Considering the report about two transactions alleged in the current case and further role of present applicant-accused, period of custody of applicant and no other criminal antecedents against the applicant, this is a fit case to enlarge the applicant on bail. 8. This Court also finds that the applicant-accused has remained in custody for a considerable period of time and that the trial/proceedings are likely to take further time to conclude. Therefore, looking to the entirety of the facts and circumstances of the case and without expressing any opinion on the merits thereof, this Court deems it appropriate to grant bail to the applicant-accused. Thus, the instant second bail application filed on behalf of applicant-accused Rajkumar S/o Shri Jile Singh Sharma, is hereby allowed and the applicant-accused is ordered to be released on bail upon furnishing a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:- (i) The applicant-accused shall not tamper with evidence or influence the witness in any manner. (ii) The applicant-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law. (iii) The applicant-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court. (iv) In case of any violation of above conditions, the bail granted to the applicant-accused shall be liable to be canceled. 10.
