HON'BLE MR. JUSTICE RAVI CHIRANIA (V.J.) Order 25/06/2026 1. Heard learned counsel for the parties and perused the material available on record. 2. This bail application has been preferred by the petitioners herein, under Section 482 of B.N.S.S., 2023, apprehending their arrest in connection with the FIR bearing No.109/2026 dated [2026:RJ-JP:23593] (2 of 4) [CRLMB-9625/2026] 23.02.2026 registered at Police Station Chaksu, District Jaipur City (South) for the offences punishable under Section 303(2) of B.N.S., 2023. 3. Learned counsel submits that the accused-petitioners are senior citizens, some of whom are about 90 years of age and have not committed any offence as alleged. It is further submitted that they are merely in possession of the land in question, which is in dispute with the complainant and the other person from the village. He further submits that they are the resident of village and has no chance of absconding, not co-operating, affecting the investigation or tampering the witnesses. In view thereof considering their age, learned counsel prays that accused- petitioners may be extended the benefit of bail by imposing any strict condition, the Court may deem proper. 4. Learned Public Prosecutor as well as the counsel for the complainant, in the presence of the Investigating Officer, strongly oppose the bail application by submitting that land belongs to Gram Sabha and petitioners herein are in illegal possession of the same. In view of the above, they pray that the petitioners may not be enlarged on bail. 5. This Court noted that the land in question pertains to various persons as per the record as well as the complainant herein. 6. Considering the age of the petitioners, the fact that there is a serious dispute about the ownership of the land in question. This Court without commenting upon the merits of the case, is inclined to exercise its powers under Section 482 of B.N.S.S., 2023, and deems it just and proper to grant the benefit of anticipatory bail to the accused-petitioners. Accordingly, this bail application filed by the accused- petitioners under Section 482 B.N.S.S. is hereby allowed and it is directed that in the event of arrest of accused-petitioners 1. Shree Ram S/o Krishna Ram, 2. Durga Lal S/o Ramdas, 3. Suresh S/o Ramlal, 4. Gopal S/o Bhura, 5. Ramnarayan S/o Sukha, 6. Shyojiram S/o Ghasiram, 7. Babulal S/o Moruram, 8. Suvalal S/o Dhannalal, 9. Rampal S/o Choturam Bairwa, 10. Prahlad S/o Kesar Ram, 11. Bansi S/o Moruram, in connection with the FIR No.109/2026 dated 23.02.2026 registered at Police Station Chaksu, District Jaipur City (South), shall be enlarged on bail provided each of them furnishes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of concerned I.O./S.H.O. on the following conditions:- (i) they shall make themselves available for interrogation by Investigating Officer as and when required and co-operate in the investigation; (ii) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any Police Officer; (iii) they shall not leave India without the previous permission of the Court. 8. The petitioners are further directed not to take undue advantage of liberty or misuse liberty. Petitioners are directed to cooperate in the investigation. In case any kind of non cooperation is found, the Investigating Officer shall file application for cancellation of this bail application.
