Petitioner has filed this petition seeking following reliefs:- “i. Issue a writ of mandamus directing the respondents to consider and grant out of turn promotion to the petitioner in view of his gallant and courageous act during the Naxalite SYED ROSHAN ZAMIR ALI Digitally signed by SYED ROSHAN ZAMIR ALI Date: 2026.01.21 10:57:10 +0530 2 encounter dated 26-27/08/2013; ii. Direct the respondents to decide the petitioner’s pending representation within a stipulated time frame. Iii. Grant all consequential benefits, including seniority and arrears, from the date the similarly situated personnel were granted such promotion. iv. Grant any other relief (s) deemed just and proper under the facts and circumstances of the case.” 2. Learned counsel for petitioner submits that petitioner is a member of Chhattisgarh Police Force and presently posted as Assistant Reserve Guard (ARG) at STF Camp Manpur, District Rajnandgaon. During his posting in District Bastar, petitioner has participated in a naxal operation. According to the policy formulated by the State Government, the police personnel participated in naxal operation is to be granted out of turn promotion in terms of provision contained in Rule 56 (3) of the Special Armed Force Rules 1973 and Regulation 70 of the Police Regulations, 1861. Petitioner submitted representation before the respondent No.2 for grant of out of turn promotion to him, however, till date no decision on it has been taken. Therefore, a direction be issued to respondent No.2, to take decision on representation of petitioner for grant of out-of-turn promotion at the earliest. 3. Learned counsel for respondent-State would submit that in view of limited prayer made by learned counsel for petitioner 3 seeking a direction against respondent No.2 to take decision on his representation for grant of out-of-turn promotion, he is having no objection. 4. Heard learned counsel for parties and perused documents available in record of writ petition. 5. On due consideration of submission of learned counsel for respective parties, this writ petition is disposed of at this stage directing respondent No.2 to take decision on petitioner’s representation (Annexure P-2) in accordance with law, expeditiously, preferably within a period of two months from the date of receipt of the order. 6.
