The instant petition is moved by the present applicant Gaurav Rathi, who is aggrieved by the order dated 11.09.2025 whereby the trial court rejected his application under Section 91 of Cr.P.C. 4. On perusal of the order impugned, it reveals that the present applicant is taking very hyper technical ground in challenging the order impugned and all these plea which he taken in this petition are completely the subject matter of the trial and he can take such plea in his defence before the trial court. 5. In such view, I do not find any merit in this petition, the same is dismissed. However, it is made clear that if the applicant take such a plea in his defence before the trial court, the trial court shall deal all such defence plea in accordance with law.
