IN THE HIGH COURT OF ORISSA AT CUTTACK CRLMP No. 326 of 2026 Bipin Bihari Nayak …. Petitioner Mr. S.K. Patnaik, Advocate on behalf of Mr. Jyotirmaya Sahoo, Advocate -versus- 1. State of Odisha 2. Director General of Police, Odisha, Cuttack 3. Superintendent of Police, Nayagarh 4. Inspector-in-Charge, Chandpur Police Station …. Opposite Parties Mr. Saroj Kumar Rout, Additional Standing Counsel CORAM: THE HON’BLE MISS JUSTICE SAVITRI RATHO Order No. ORDER 30.03.2026 02. (Through hybrid mode) 1. This CRLMP has been filed for a direction to the Opposite Parties, especially the Opposite Party Nos.3 and 4 to complete the investigation in Chandpur P.S. Case No.38 of 2023. 2. Perused the instructions as well as the copy of the case diary produced by Mr. S.K. Rout, learned Additional Standing Counsel. 3. It appears that almost identical entries have been made on 01.03.2023, 02.03.2023, 15.03.2023, 08.04.2023, 20.07.2023, 07.10.2023, 10.02.2024, 02.08.2024 by the first I.O. till his transfer. Thereafter the next I.O. has made similar entries on 05.04.2025, 20.06.2025, 15.09.2025 till his transfer. Thereafter the IIC, Chandpur P.S. has again examined the complainant and other witnesses (tested them) on 12.01.2026 but it is mentioned in the case diary that as they stated nothing, the statements are not recorded. He has also conducted raid at Sreeragam Company at Bent and searched for accused on the same day i.e. 12.01.2026, next day 13.01.2026. On 28.03.2026, five years after registration of the FIR, prayer has been submitted to the IG of Police, Central Range for permission to proceed to Visakhapatnam, State Andhra Pradesh, to trace the accused. Thereafter the case diary is silent whether permission was given or not. 4. From this it is apparent that the investigation in this case has not progressed at all for which the S.P., Nayagarh is directed to examine the records and take a decision within two weeks to either change the I.O. in this case or to ensure that it is supervised by a competent officer, so that investigation which is pending since more than five years will be completed expeditiously. 5. With the above observation, the CRLMP is disposed of. 6. It is open to the Petitioner to avail alternate remedy which is available to him under law in case of failure of Police to complete the investigation in this case within a period of four months from today. 7. Copy of this order be communicated by the Registry to Opposite Party No.3, S.P., Nayagarh forthwith by e-mail. (Savitri Ratho) Judge RKS
