JUSTICE PURNENDU SINGH ORAL ORDER 2 08-04-2026 Heard learned counsel appearing on behalf of the petitioners and the learned APP for the State. 2. Petitioners seek pre-arrest bail in connection with Turkauliya P.S.Case No.577 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 303(2), 109, 324(4), 352 and 351(2) of BNS. 3. No.20357 of 2026(2) dt.08-04-2026 2/3 co-accused persons including the petitioners assaulted the informant with iron rod, fats and stick, causing injuries on the different parts of his body, as well as, they snatched gold chain and gold rings worth Rs.3,50,000/- and also they tried to kill the informant by wrapping muffaler around the neck of the informant. 4. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent. Learned counsel further submitted that in absence of overtact attributable to them, they deserve to be released on pre-arrest bail. 5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail to the petitioners. 6.
Having considered the rival submissions made on behalf of the parties, as well as, in absence of overtact attributable to the petitioners, the petitioners are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned district court within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran, Motihari/concerned court, in connection with Turkauliya P.S.Case No.577 of 2025, subject to conditions as laid down
