This is an application under Section 483 of BNSS, 2023 in connection with Page No.# 2/3 Noonmati P.S. Case No. 13/2026, under Sections 304(2)/112(2) of BNS, for granting bail to the petitioner. On 16.01.2026, the complainant Deben Pegu, age about 65 years resident of House No. 247 Patharquarry, VIP road, Noonmati, District Kamrup(M), Assam, Mobile No. 7896006516, lodged a written FIR before the Officer-in-Charge, Noonmati Police station. The complainant stated on 15.01.2026 at about 12:30 PM, he had withdrawn an amount of Rs 4,50,000/- (four lakh fifty thousand only) from SBI, GRC branch Noonmati. After withdrawal, his son Madhurjya Pegu, 29 years, kept the cash in a bag and proceeded along with the complainant in their vehicle and eco sport (four wheeler). While proceeding, they noticed that one tyre of the vehicle got punctured, following which they spotted at IOCL petrol pump, Sector III, Noonmati. At that time two unknown male persons approximately 90 kg in weight, arrived on a pulsar motorcycle and snatched the cash -filled bag from the hand of Madhurjya Pegu, and fled from the spot. The complainant further stated that the snatching motorcycle bears registration number AS- 18-G-5825 (pulsar) and that a white coloured swift four-wheeler was suspiciously following them, which is suspected to be involved in the Commission of the offense. It is submitted on behalf of the petitioner that the petitioner is not Page No.# 3/3 connected with the alleged offence in any way and nothing has been recovered from his possession. On perusal of the Case Diary, it appears that in the present case, the petitioner has been shown arrested on 05.05.2026 and he is already arrested in connection with another case and it appears that the petitioner has been operating in the aforesaid area indulging in similar offences. Having regard to the incriminating materials available in the Case Diary, the prayer for bail stands rejected at this stage. The petition is dismissed accordingly. Send back the Case Diary.
