BLAPL No.2115 of 2026
Harish Chandra Das …. Petitioner(s)
Mr. Amit Prasad Bose, Advocate
-versus-
State of Odisha …. Opposite Party(s)
Mr. Jateswar Naik, AGA
CORAM: JUSTICE SIBO SANKAR MISHRA
Order No.
ORDER 22.04.2026
03. 1. Heard. 2. The petitioner is an accused in connection with Dhanupalli P.S. Case No.23 of 2025 corresponding to S.T. Case No.109/66 of 2025 on the allegation of the commission of the offences under Sections 137(2)/140(3)/115/64(2)(d)(m)/109(1)/88/74/351(2) of B.N.S., 2023 pending in the Court of the learned 1st Additional Sessions Judge, Sambalpur. 3. The prosecution case, in brief, is that on 25.10.2024, the victim, aged about 31 years, left her house following an altercation with her brother. However, her neighbour persuaded her to stay at their house for that night. On the next morning, at about 5:30 A.M., she went to Gayatri Temple and claimed to
have become a “Mata”, but the temple authorities did not accept her on the ground that she was mentally unwell. Thereafter, she went to Daleipada School, where she was found weeping. At that time, the owner of Samarth Ashram at Netaji Nagar, namely Harish Chandra Das, along with his son Lucky, took her in an auto-rickshaw. It is further alleged that on the same day, i.e., 26.10.2024, Harish Chandra Das established physical relations with her in the presence of one Swagatika Pradhan and also subjected her to repeated assault. Hence, the FIR. 4. The petitioner has filed the present application challenging the order dated 26.12.2025 passed by the learned trial Court rejecting his prayer for regular bail. Mr. Bose, learned counsel for the petitioner at the outset submits that he is presently seeking for interim bail on medical ground. He fairly submits that although he made similar prayer before the learned trial Court, however, without there being any document annexed to support his case for interim bail on medical ground, the learned trial Court did not accede to his request. However, in the present petition, he has annexed certain medical documents showing his illness. 5. In view of the aforementioned, although I am not inclined to enlarge the petitioner on bail, however, liberty is granted to him to move application before the learned trial Court for grant of interim bail on the
medical ground by annexing the similar document or any other supporting documents available to him.
If such application is filed, the learned trial Court shall release the petitioner on interim bail for a period of one month or for any other period as may deem fit and proper, subject to the verification of the health condition and after verifying the authenticity of medical documents to be filed by the petitioner. 6. With this observation, the BLAPL stands
disposed of.
