JUSTICE SANJEEV KUMAR SHARMA ORDER 24.06.2026 Heard Mr. J. Ahmed, learned counsel for the petitioner. Also heard Ms. S. Newar, learned Amicus Curiae for the respondent No. 2. Page No.# 2/3 This is an application under Section 483 of BNSS, 2023 in connection with Hajo P.S. Case No. 149/2026, under Sections 74/76/137(2)/351(2)/3(5) of BNS read with Sections 12/14/15 of POCSO Act, for granting bail to the petitioner. The allegation against the petitioner is that on the night of 17.04.2026, when the victim aged about 17 years have gone to the bathroom, she was dragged away by the petitioner to a four wheeler vehicle, threatened with a knife to undress herself and took photographs of her and threatened to make the same viral. The learned counsel for the petitioner submits that considering the length of detention of the petitioner of nearly 22 days in custody, the prayer for bail may be considered. The Case Diary as called for has been received. On perusal of her statement before the Magistrate, it appears that besides the aforesaid allegations in the FIR, the petitioner also committed sexual assault upon the victim who is a minor. There also appears to be other incriminating material against the accused person. Considering the gravity of the offences and the incriminating materials on record, the prayer for bail stands rejected at this stage. Page No.# 3/3 The petition is dismissed accordingly. Send back the Case Diary. JUDGE Comparing Assistant
