UKHC010128252026 2026:UHC:6459 SL. No. Date Office Notes, reports, orders or proceedings or directions and Registrar’s order with Signatures COURT’S OR JUDGE’S ORDERS WPMS/2201/2026 Vimla Devi --Petitioner Versus Surendra Singh & another--Respondents Hon'ble Manoj Kumar Tiwari, J. Mr. Karan Anand, Advocate for the petitioner. 2. Petitioner has challenged order dated 10.07.2026, passed by Additional Commissioner, Garhwal Division in a revenue revision, whereby the application seeking leave to amend the array of parties was allowed. 3. Perusal of the record reveals that Smt. Krishna and Smt. Sumati Devi were party to Revenue Suit, who passed away during pendency of the suit, but due to mistake, they were added as respondents in the revision petition, which was filed against order of temporary injunction passed by Trial Court. By the order of interim injunction, parties were restrained from creating third party interest qua the suit property during pendency of the Suit. 4. Learned Revisional Court held that leave to amend sought by petitioner, if granted, will not change nature of the proceedings nor jurisdiction of the Revisional Court will be affected, therefore in the interest of justice, the prayer for amendment deserves to be UKHC010128252026 2026:UHC:6459 allowed. 5. This Court does not see any reason to interfere with the impugned order. A mistake, which crept in, in the array of parties, was sought to be corrected. Since there is no prejudice caused to petitioner or any other person by grant of leave to amend, therefore, learned Revisional Court was justified in allowing the prayer for amendment. 6. Accordingly, the writ petition fails and is dismissed.
