The accused petitioners have approached this Court by filing the instant bail applications under Section 483 B.N.S.S. 2023 arrested by the police in connection with the FIR bearing No.1157/2025 dated 22.11.2025 registered at Police Station Muhana, District Jaipur City (South), for the offences punishable [2026:RJ-JP:23530] (3 of 5) [CRLMB-17172/2025] under Section 115(2), 126(2), 127(2), 140(2), 308(5), 307 and 61(2) of B.N.S., 2023. 2. Learned counsel for the accused-petitioners while arguing the case independently submitted that as the complete case registered by the police at the instance of the complainant is false and baseless as some of the petitioners herein had some financial dispute in regard to monetary transaction and as a consequence of the same, the impugned FIR has been lodged by levelling the false and baseless allegation. 3. Counsel further submitted that the petitioners have kidnapped the complainant not have they taken any amount as alleged. It is further submitted that whatever amount was received, was only in respect of their previous financial transaction and dispute between the parties. Counsel further submitted that the complainant, who is 45 years old man, was trying to develop relationship with a girl aged about 22 years, one of the accused herein and therefore his conduct is serious. 4. Lastly, learned counsel submits that the police, after conducting the investigation, had filed the charge-sheet and therefore there is no purpose would be served by keeping the petitioners behind the bars as no further interrogation and recovery is required, therefore, it is prayed that the petitioners may be enlarged on bail by this Court. 5. Learned Public Prosecutor along with the learned counsel for the complainant strongly opposed the bail applications, submitting that the conduct of the petitioners herein is very serious in nature. They submitted that the complainant was kidnapped by the petitioners who under threat to his life. They got [2026:RJ-JP:23530] (4 of 5) [CRLMB-17172/2025] a sum of Rs. 1,00,000/- transferred through digital mode by using a UPI ID. Further they forced the complainant to withdraw additional amounts from various ATMs on the same day. After severely assaulting the complainant, he was thrown at the place mentioned in the FIR in a critical condition. 6. In view of the above, learned counsel submits that the present petitioners do not deserve to be enlarged on bail, considering the gravity and their serious conduct. 7. This Court considered the fact that the petitioners are aged between 19 to 22 years however while considering their age, this Court has also examined the nature and gravity of the allegations as reported in the FIR. It has been alleged the petitioners kidnapped the complainant, took him to various places during which they severely assaulted him as reflected from the photographs available in the case diary. 8. This Court further noted that an amount of Rs.1,00,000/- has transferred by complainant in the name of one Dilkhush Meena, who is close known person of one of the accused, Rahul Meena, however the Police has not yet been able to arrest the person Dilkhush Meena and another accused despite the lapse of more than 6 – 7 months. Considering the overall facts and circumstances of the present case, this Court is of the prima facie opinion that the petitioners have formed some kind of illegal group. The Court further observed the Jaipur, being an International city, cannot permit such kind of crime, to be committed by the young individuals forming such groups. The conduct of the petitioners cannot be taken lightly. In view of the above, this Court is not inclined to enlarge the petitioners on bail. [2026:RJ-JP:23530] (5 of 5) [CRLMB-17172/2025] 9.
