The petitioner who made an application for being released on parole leave on 05/06/2025 received rejection from both the Authorities and therefore the present writ petition is filed. According to us, the contingency stipulated in the application being illness of his mother which was a year before, definitely cannot exist in the same form as on date as his mother must have been cured or her health must have further deterioted. In either of the contingency, due to passage of time, according to us, petitioner should file fresh application which shall receive due consideration from the Authorities. The learned counsel for the petitioner, therefore seeks withdrawal of the writ petition with liberty to make a fresh application and upon such application being made, we direct the Authority to consider it in accordance with the prevailing Rules.
