The petitioners are apprehending their arrest in connection with Jamtara P.S. Case No.98 of 2025, for offence registered under section 303(2) of BNS, 2023, sections 4 and 21 of Mines and Mineral Development and Regulation Act and sections 9 and 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, pending in court of learned C.J.M., Jamtara. 3. Learned counsel for petitioner submits that petitioner no.1 is owner and petitioner no.2 is driver of 407 truck and allegations are made that 250 cft sand was loaded. He submits that petitioners are having no criminal antecedents as disclosed in para 12. 2026:JHHC:696 2 4. Learned State counsel opposes prayer and submits that illegally the sand was loaded. 5. Considering that petitioner no.1 is owner and petitioner no.2 is driver of 407 truck and petitioners are not having any criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioners. 6. Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within four weeks from today, and in event of their surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned C.J.M., Jamtara, in connection with Jamtara P.S.
