JUSTICE PARTHIVJYOTI SAIKIA ORDER 24.06.2026 Heard Mr. A Ahmed, learned counsel appearing for the petitioners. Also heard Mr. D P Goswami, learned Additional Public Prosecutor, Assam. This is an application filed under Section 482 of the BNSS, 2023 whereby the petitioners Hussain Ahmed and Samim Ahmed have prayed for pre-arrest bail in connection with Ratabari P.S. Case No. 78/2026. It is alleged in the FIR that the petitioners had gone to the house of the informant. They attacked the informant and hit her on her back. They also dragged away the daughter of the informant in a car. Subsequently, the girl was dropped in front of a petrol pump. I have gone through the statement of the victim girl that was recorded under Section 183 of the BNS, 2023. After considering the submissions made by the learned counsel for both sides, this court is of the opinion that there are no prima facie materials against the present petitioners. Therefore, the petitioners do not deserve to be detained in custody. Hence, their pre-arrest bail is allowed. It is hereby directed that in the event of arrest of the petitioners, namely, Hussain Ahmed and Samim Ahmed in connection with Ratabari P.S. Case No. 78/2026, the arresting authority shall release them on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the arresting authority.
