JUSTICE M.NAGAPRASANNA - 3 - HC-KAR NC: 2026:KHC:15352 CRL.P No. 4071 of 2026 ORAL ORDER The petitioners are before this Court calling in question the registration of a crime in Crime No.9/2026 for the offences punishable under Sections 115(2), 54, 352, 351(2) read with Sections 3(5) and 85 of the Bharatiya Nyaya Sanhita (BNS), 2023 and under Sections 3 and 4 of the Dowry Prohibition Act, 1961. 2. Heard Sri. M.R.Hiremathad, learned counsel appearing for the petitioners, Sri. B.N.Jagadeesha, learned Addl. SPP appearing for respondent No.1, Ms. Baby Yadav.B., learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have filed a compounding application along with the joint affidavit. The joint affidavit so filed reads as follows: "JOINT AFFIDAVIT We. 1) Salman T N, S/o T Noor Ahmad, aged about 31 years, R/at Indira Badavne, Near Santepete School Road, Jagaluru, Davanagere, 2) Anju Banu R,W/o Salman T N Aged about 25 years, Mallanaikanahalli, Guddadahalli Post,Harihara Talluk Davanagere District, today at - 4 - HC-KAR NC: 2026:KHC:15352 CRL.P No. 4071 of 2026 Bengaluru do hereby solemnly affirm and state on oath as follows: 1. I, the first party being the petitioner No. 1, and the second party, being the respondent No. 2, in the above petition. We are the husband and wife. Today also we are residing in the same roof as husband and wife. 2. We further state that on 18.12.2025, I being the second party/wife undergone for inevitable abortion in my first Trimester (During 9-10weeks). 3. We further state that both/were having too much eagerness regarding baby. 4. We further state that in view of the last pregnancy, we had blamed against each other. Resultantly subject FIR of this petition has been registered against me(First Party) and my parents. 5. I, the 2nd party stated that when the dispute has arose between us, I was ill advised by some person, those are our distant relatives and friends. Resultantly subject FIR of this petition has been registered against my husband and parents-in-law. 6. We further state that even after registration of FIR we are residing together as husband and wife from 3rd week of January, 2026. 7. I further state that I am the petitioner No:1 in the above petition and I know the facts Hence, I am able to swear to this affidavit myself and on behalf of other petitioners. WHEREFORE, we jointly prayed that this Hon'ble Court kindly be pleased to allow the annexed application by allowing above petition in the interest of justice and equity." - 5 - HC-KAR NC: 2026:KHC:15352 CRL.P No. 4071 of 2026 4. The parties to the lis are present before the Court and are identified by their respective counsel. 5. In the light of application for compounding being filed along with the joint affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against these petitioners in the subject petition. 6. For the aforesaid reasons, the following: ORDER i. Criminal Petition is disposed. ii. Proceedings in Crime No.9/2026, stand quashed qua these petitioners. As a consequence, I.A.No.1/2026 is disposed.
