HC-KAR NC: 2026:KHC:8523 WP No. 5103 of 2025 ORAL ORDER Learned AGA takes notice for both the respondents.
2. The grievance of the petitioners is that, despite there being a judgment and decree passed by the learned Additional Civil Judge and JMFC, Channapatna in OS No.26/2022 filed by the petitioners herein, declaring that the petitioners herein are the absolute owners of the suit schedule property namely, 05 acres and 13 guntas in Survey No.84 of Shanuboganahalli, Virupakshipura Hobli, Channapatna Taluk, Ramanagara District in terms of Registered Sale Deed dated 14.03.1968, the Tahsildar is not entering the names of the petitioners in the revenue records. On the other hand, the Tahsildar has issued the impugned endorsement at Annexure-D dated 06.04.2024 that the decree is not registered in the office of the Sub Registrar.
3. The requirement of registration of decree of the Court may not arise in the present facts and circumstances of the case. The judgment and decree is not for partition and separate possession of the lands in question. The declaration is that the petitioners herein, who are plaintiffs, are the absolute owners

4. Consequently the writ petition is allowed. The impugned endorsement at Annexure-D issued by the respondent- Tahsildar, Channapatna Taluk is hereby quashed and set aside. The respondent-Tahsildar, Channapatna Taluk is hereby
directed to proceed to enter the name of the petitioners in the revenue records pursuant to the judgment and decree passed by the Competent Civil Court in OS No. 26/2022. The entire exercise shall be completed as expeditiously as possible and at any rate within period of six weeks from the date of receipt of a copy of this order, subject to any stay being granted by the Appellate Court in respect of the judgment and decree passed in O.S.No.26/2022.
