JUSTICE PRAMIL KUMAR MATHUR Order 29/06/2026 The bail application qua petitioner No.1 Umardeen has already been withdrawn by learned counsel for petitioner on 20.05.2026. Hence, no further order is required. In S.B. Criminal Miscellaneous Bail Application No. 6921/2026:- 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.89/2015 registered at Police Station Pahadi, District Bharatpur for offences under Sections 147, 148, 149, 341, 323, 307 and 302 of IPC. Heard learned counsel for the petitioner, learned counsel for the complainant as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. There is no specific allegation against the petitioner of firing at the deceased Hamid and Hanif. It is further contended that co-accused Aslam was granted bail by Co-ordinate Bench of this Court vide order dated 03.09.2015. Co- accused Zahul was also granted the benefit of bail by Co-ordinate Bench of this Court vide order dated 20.08.2015. Other co- accused Ayyub and Sahun were also granted the benefit of bail by Co-ordinate Benches of this Court vide orders dated 25.02.2021 and 18.03.2021 respectively and co-accused Aameen and Kasam also granted benefit of bail by this Court on 20.05.2026. The case of the petitioner is on better footing. Petitioner is behind the bars since 07.04.2026 without any criminal past. The trial of the case will take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody and on the ground of parity with other co-accused, the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submissions and material available on record and in light of submission made on behalf of petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Arsad S/o [2026:RJ-JP:23706] (3 of 3) [CRLMB-6921/2026] Farid, be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
