The petitioner is aggrieved by Annexure-13 by which he has been removed as the Principal In-charge of KSGM College, Nirsa, affiliated under the Binod Bihari Mahto Koylaanchal University, Dhanbad. 3. After hearing the parties and after going through the impugned order, I find that the petitioner has merely been removed as In-charge, Principal and one Manik Chandra Ojha, who was the Head of the Economics, have been given the charge of the Principal. Further, during course of argument, it has been brought to the notice of this Court that both this petitioner and Manik Chandra Ojha has superannuated. 4. The substantive post is of the Principal. There is no substantive post as “In-charge Principal”. Since the post of Principal was vacant, petitioner being the senior most was given the charge to perform as the Principal. There is no substantive right created in favour of the petitioner. Based on some complaint, the petitioner was removed as the In-Charge and Manik Chandra Ojha was made the Principal In-Charge. 5. Now since the petitioner has already superannuated, and further since the petitioner has got no vested right to become an In-charge, no relief can be granted to the petitioner.
