Heard Mr. J Islam, the learned counsel for the petitioners. Also heard Mr. R J Baruah, the learned Additional Public Prosecutor appearing on behalf of the State respondent. 2. This is an application u/s 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for granting pre-arrest bail to the accused/petitioners in connection with PRC Case No. 201 of 2026 u/s 61(2)/318(2)/109(2) and added section 103(2) of BNS. 3. It is submitted by Mr. Islam that the present accused/petitioner along with two others earlier filed an anticipatory bail wherein the the two accused/persons were granted with the interim protection and they accordingly they appeared and cooperated with the investigation of this case. However, after rejection of the bail prayer for the present accused/petitioner, the charge-sheet was filed within 5 days from the date of earlier rejection order of anticipatory bail and thus the accused/petitioner did not get any chance to cooperate with the investigation of this case though they were ready for their cooperation. However, the petitioners are ready and willing to extend their cooperation in further investigation of the case, if they are granted with some interim protection. 4. Mr. Baruah, the learned Additional Public Prosecutor submitted in this regard that petitioners may be directed to appear before the learned Trial Court below with a regular bail application but no interim protection may be granted to the petitioners as they never cooperated in the investigation of this case. Hearing the submissions made by learned counsel for both sides and considering other aspects of this case, it is seen that only summons has been issued to the present petitioners by the learned Trial Court/ Committal Court. However, considering the submission made by Mr. Islam, the petitioners are hereby directed to appear before the learned Committal Court i.e. before the learned SDJM, Bilasipara with an application for bail, which may be considered in accordance with law. 6. However, till next date of listing i.e. 02.07.2026, no coercive action shall be taken against the present petitioners. 7. With the above observations, this petition stands disposed of.
