Ms. Priya Mewari and Mr. Deepak Pandey, learned counsel for the applicant. 2. Mr. Sandeep Sharma, learned A.G.A. for the State. 3. The present applicant ‘Gurpreet Singh @ Monu’ S/o Bhagwan Singh is praying for bail in reference to First Information Report dated 06.08.2025 bearing FIR No. 0288 of 2025 P.S. Ramnagar, District Nainital, which was lodged against unknown person for the offence punishable under section 140 (3) of BNS, 2023, by the complainant with regard to missing of his daughter and on completion of investigation the applicant has been chargesheeted for the offences punishable under sections 64(1), 87 and 137(2) of BNS, 2023, read with section ¾ of POCSO Act. 4. It is submitted by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and infact the applicant and the victim were in love which she admits during her examination in chief on 13.01.2026. She submits that the victim at the time of incident was 17 and ½ years old and was at the verge of attaining the age of majority and infact both of them want to marry. She further submits that the applicant has no previous criminal antecedents and is languishing in jail since 06.08.2025 and the charge-sheet has already been filed and even the trial has been commenced and taking into consideration that the present applicant is languishing in jail since last more than 11 months UKHC010068822026 2026:UHC:6329 and the victim herself admits about their romantic relation, therefore, the applicant be released on bail. 5. On the other side, learned A.G.A. have not disputed that the present applicant has no criminal antecedent and is languishing in jail since 06.08.2025 and the trial has already been commenced and also submits that as per the examination-in-chief of the victim both of them known to each other. 6. After hearing the submission of the learned counsel for the applicant and taking into consideration that the trial has already been commenced and the applicant is languishing in jail since 06.08.2025 and have not criminal antecedent, this court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant ‘Gurpreet Singh @ Monu’ be released on bail on furnishing his personal bond and two reliable sureties each of the like amount to the satisfaction of the court concerned subject to the following conditions: i. After being released on bail the applicant shall join the Trial Court proceeding on each and every date without seeking any unnecessary adjournment. ii.
