The present applicant ‘Hem Chandra Pant S/o Shri Govind Ballabh Pant is praying for bail in reference to First Information Report dated 13.06.2023 bearing FIR No. 0246 of 2023 P.S. Ramnagar, District Nainital, wherein, the present applicant along with four others were implicated for the offence punishable under section 409 of IPC. 4. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated and is languishing in jail since 05.02.2026. He further submits that as per the prosecution the applicant was the Manager of the Society namely “Dev Bhoomi Bahuddeshiya Cooperative Society” and neither there is any recovery from the present applicant nor there is any evidence with regard to such embezzlement of the amount. He further submits that the offence as alleged is triable by the Magistrate and the charge-sheet has been filed. 5. On the other side, learned A.G.A. have not disputed that the charge-sheet has been filed and the offence as alleged is triable by the Magistrate and the present applicant is languishing in jail since 05.02.2026. 6. After hearing the submission of learned UKHC010069122026 2026:UHC:6343 counsel for the parties and taking into consideration that the offence is triable by the Magistrate and the applicant is languishing in jail since 05.02.2026, this court is of the view that the applicant deserve for bail. 7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed. 8. Let the applicant ‘Hem Chandra Pant’ be released on bail on furnishing his personal bond and furnishing two reliable sureties each of the like amount to the satisfaction of the court concerned.
