By this application, the applicant is seeking anticipatory bail in connection with Crime No. 119/2026 registered with Police Station Nandanwan, Nagpur City for the offences punishable under Sections 109 and Section 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The brief facts of the prosecution case are that the applicant is a friend of the injured person, namely Shahbaz Khan. On 15/03/2023, at around 8.00 pm, the applicant came to the house of informant and had a conversation with his brother i.e. Shahbaz after which they left the place. Thereafter, the co-accused who is the brother of applicant, namely Bashir Akhil Sheikh came to the house of the informant and asked the brother of informant i.e. the 2 20 ABA 800.26 injured Shahbaz Khan to accompany him for offering Namaz at Masjid, to accompany him Shahbaz Khan went with the accused no.1 on his motorcycle. At about 9.00 pm, the sister of the informant has informed him that Shahbaz has been assaulted by Bashir and the present applicant with the help of knife. Upon receiving the said information, the informant alongwith his family members rushed to the spot and thereafter the injured Shahbaz was taken and admitted to the hospital for medical treatment. Based on this information, the first information report was registered on 16/03/2026. 4. This Court by an order dated 08/09/2026 has passed a detailed order granting interim protection to the applicant. Pursuant to the said order, the applicant had cooperated with the Investigating Agency as submitted by the learned APP upon instruction. Under such circumstances, I am of the considered opinion that the order dated 08/09/2026 needs to be confirmed in the given set of facts. Hence, the following order:- ORDER (I) Application is allowed and disposed of. (II) The order dated 08/09/2026 is hereby confirmed 3 20 ABA 800.26 on the same terms and conditions as incorporated in the said order. 5. Pending application (s), if any, stand disposed of accordingly. 6. The observations of this Court are prima facie in nature and are only limited to this application.
